1) Who We Are and Why This Policy Matters
Beyond Africa Safaris (Pty) Ltd ("Beyond Africa Safaris", "we", "us", "our") is a South African private company dedicated to designing exceptional African safaris, tours, and curated travel experiences. We respect your privacy and protect your personal data with care and rigor.
What governs us:
The Protection of Personal Information Act, 2013 (POPIA). Where applicable, we also follow the EU/UK GDPR, UK DPA 2018, and relevant U.S. state privacy laws (e.g., CCPA/CPRA).
This Policy covers every way you interact with us—website, landing pages, email, WhatsApp/SMS, phone, and any mobile/app experiences (collectively, the "Site").
2) Our Zero-Spam Promise
We do not send unsolicited emails. We will only email you when:
- You request support (e.g., password resets, account help)
- You opt in to newsletters or trip inspiration (unsubscribe any time)
- You contact us or request a quote; we'll reply and send you a copy
- Operational/legal notices are essential (e.g., material privacy or ownership changes)
3) What We Collect (Only What's Needed) and Why
We keep data collection lean and purpose-driven. If you choose not to share certain details, we may be unable to provide some services.
3.1 Enquiries & Quotes
Data
Name, email, phone, trip details (dates, group size, interests), IP (anti-spam/security)
Use
Respond to your enquiry, create quotes, personalise recommendations, prevent abuse
Sharing
Only with vetted suppliers strictly as needed to progress your trip
3.2 Bookings & Travel Fulfilment
Data: Traveller names, contact details, itinerary, preferences, and where required by parks/airlines/immigration: passport or ID details, date of birth, nationality.
Use: Issue confirmations and vouchers; secure permits; coordinate lodges, transfers, guides; handle changes/cancellations; support you throughout travel.
3.3 Reviews, Photos & Community Content
Data: Screen name (full/first name), location/country, age range, experience level, photos/videos you upload; email (private for admin issues); IP (anti-spam).
Use: Publish your review, showcase your media (with consent), combat abuse.
Visibility: Your chosen display info appears publicly; email and IP remain private.
Control: You can edit/delete your review; see Retention for timelines.
3.4 Accounts (Optional)
Data: Email (or social login token) and encrypted password; minimal device/IP signals for fraud prevention.
Use: Sign-in, save favourites, faster quoting, smoother checkout.
3.5 Site Logs & Diagnostics
Data: Standard server logs including IP, URLs visited, timestamps, basic device/browser metadata.
Use: Keep the Site secure, debug errors, measure performance, prevent abuse.

5) Our Legal Bases (Why It's Lawful)
- Contract: Enquiries, quotes, bookings, payments, travel support
- Consent: Newsletters, marketing cookies, publishing your photos, any special-category health/dietary/mobility data
- Legitimate Interests: Site security, fraud prevention, service improvement, non-intrusive personalisation, aggregate analytics (balanced with your rights)
- Legal Obligations: Tax/accounting, border/park authorities, regulator requests, court orders
6) How—and With Whom—We Share Data
We keep your data confidential. We only disclose what's needed, when needed:
- Travel suppliers (independent controllers): Select lodges, camps, airlines, park authorities, transfer and activity operators—solely to deliver your itinerary
- Service providers (processors): Secure hosting, email/SMS, CRM, helpdesk, analytics, fraud detection, surveys—under contract and our instructions
- Email marketing: Only if you subscribe; we share your email with our mailing platform
- Social/ads: Only with your explicit consent (often via hashed identifiers)
- Corporate events: Merger/transfer with continuous protections
- Legal: To comply with law, enforce terms, protect people and property, prevent fraud/abuse
Cross-border transfers
Safaris are global. When your data leaves South Africa (or the EEA/UK), we use approved safeguards (e.g., Standard Contractual Clauses, adequacy, or equivalent). Details available on request.
7) Security You Can Rely On
We apply layered, risk-based safeguards: TLS/SSL encryption, hardened hosting, role-based access, MFA where appropriate, data minimisation, supplier due diligence, staff confidentiality, and ongoing monitoring.
8) Your Rights (Easy to Use, Fast to Action)
Subject to law, you can:
- Access your data
- Correct inaccuracies
- Delete certain data (we'll tell you if law requires retention)
- Object to/restrict certain processing
- Withdraw consent at any time
- Portability (where applicable)
How to Exercise Your Rights
Email res@privatetourscapetown.com with subject "Data Rights Request" and the email/phone you used with us. For security, we may ask for basic verification.
Timelines: We aim to respond within 7 days and resolve within 30 days.
9) Children
Our services are not directed to children under 16. We don't knowingly collect data from children. If you think a child provided data, contact us and we'll delete it, unless the law requires retention.
10) Data Retention
We retain data only as long as needed, then delete or anonymise it. Typical periods:

Depending on your state, you may have rights to know/access, correct, delete, and opt-out of cross-context behavioural advertising ("sharing").

- We do not knowingly share personal information of minors under 16
- Use our footer "Do Not Sell or Share My Personal Information" (if present) or email us
- We won't discriminate for exercising your rights
12) Third-Party Sites & Platforms
Links and embeds (maps, videos, social) are governed by those providers' privacy policies. Check them before submitting information.
13) Automated Decisions & Fraud Controls
We use automated risk scoring to block fraud/abuse (e.g., suspicious transactions). If you're blocked and believe it's wrong, you can request human review, express your view, and contest the decision.
14) Changes to This Policy
We keep this Policy current with law and best practice. The "Last Updated" date tells you when we changed it. Major updates will be clearly flagged for a reasonable time. Continued use of our Site after updates means you accept the changes.
